N. Tonawanda man to get $5.5 million for on-job injury
********, a North Tonawanda heating and ventilation system installer who was injured while working at a Town of Tonawanda gas station three years ago, has accepted a $5.5 million insurance settlement, his attorney said Tuesday.
John F. Maxwell said ********, 32, will get $2 million within the next month and then periodic payments totaling an additional $3.5 million from carriers for United Refining Co. of Pennsylvania and Tri-R Cooling & Heating of West Seneca.
Then working for Tri-R, ******** was installing a heating and air conditioning unit on the roof of a United Refining-owned gas station at 4205 Delaware Ave., on May 15, 1998, when a cord securing the ladder he was on broke and he fell 15 feet.
A State Supreme Court Justice ruled in ********’s favor on liability issues in March, 2000, and a trial on damages was about to start when the settlement offer was made, Maxwell said. ******** hopes to return to school to retrain for a job within his physical limitations. – The Buffalo News
